Can someone explain with detail what a pre settlement lawsuit loan is?

Answer: It is a loan contingent on your settlement. They will loan you money and you GIVE them rights to your settlement to get their money back when the settlement is paid out. NOTHING is free and these types of loan transactions will cost you plenty. There will most likely be a high dollar amount of fees and cost they will attach to the transaction. If you really need some of the money to live and pay bills then you must do what you need to do. I strongly advise against these types of loans as they can be close to scandalous. BE SURE you talk with more than one company, ASK/DEMAND references and check the BBB. This is your money, you most likely have already given or will give your attorney 1/3 of the total. What to include in a payday loan lawsuit?

Question: I'm filing a small claims lawsuit against a payday loan company that attempted to deduct money from my checking account, subsequently causing overdraft fees. I have never done business with this company. I'm suing for the maximum allowed and I am representing myself. In the section of the form that asks the plaintiff to state briefly the basis for the demand, how should I word it? Meaning, how should I explain what happened succinctly and in a short paragraph? Please serious responses only.




Answer: You explained here quite well. That's a good starting point. You might want to add a little more detail that you didn't mention to us, though. Like what happened when you contacted them to rectify the problem, what paperwork they sent you when you demanded it, and so on.
